The petitioner seeks bail in a case registered for offences punishable under Sections 30, 30(G), 38(1)(2) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 44.280 liters of foreign liquor were recovered from a vehicle. It is further contended that petitioner was not apprehended from the spot rather his name has cropped up in view of the confessional statement of co-accused, Mohan Kumar, who has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 10.07.2017 passed in Criminal Miscellaneous No.31334 of 2017. Petitioner claims his antecedent to be clean
Patna High Court Cr.Misc. No.33683 of 2017() dt.20-07-2017 2/2 and he is in custody since 10.06.2017.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of ADJ II, Spl. Judge- Excise Act, Sitamarhi in connection with Runnisaipur P.S. Case No.263/2017. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
