====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Alamnagar P.S. Case No. 236 of 2025 dated 15.07.2025 registered for the offences punishable under Sections 309(4) of the B.N.S., 2023 and Sections 25(1-B) (a), 26 and 35 of the Arms Act.
3. As per the prosecution case, the miscreants looted a cash of Rs. 8,000/ to 10,000/- from the informant on the gun point. Later, the petitioner was apprehended by the local police and from his possession, one country made
Patna High Court CR. MISC. No.67017 of 2025(2) dt.13-10-2025 2/3 pistol and a motorcycle without number plate was recovered. Later, the petitioner disclosed the name of the co-accused Sonu Kumar.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that no incriminating article has been recovered from the possession of the petitioner. It is further submitted that the alleged recovered arms and ammunition and the motorcycle does not belong to the petitioner and the petitioner has no concern in any manner with the alleged arms, ammunition and the motorcycle. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 15.07.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty
Patna High Court CR. MISC. No.67017 of 2025(2) dt.13-10-2025 3/3 Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Udakishunganj, Madhepura in connection with Alamnagar P.S. Case No. 236 of 2025.
