JUSTICE RAKESH KUMAR ORAL ORDER 07-02-2017 Heard Sri Ram Chandra Prasad, learned counsel for the petitioners as well as Sri Durgesh Kumar Singh, learned counsel for the New India Assurance Co. Ltd. None appeared on behalf of the opposite party no. 1A and 1B whereas, opposite party no. 1A and 1B have already entered appearance through their counsel. The present petition has been filed with a prayer to restore MJC No. 3044 of 2010, which stood dismissed due to non- compliance of peremptory order dated 13.11.2013. The MJC No. 3044 of 2010 was itself filed for restoration of earlier restoration petition, which too was dismissed due to non compliance of peremptory order. The first restoration petition i.e. MJC No. 945 of 2010 was filed for restoration of Miscellaneous Appeal No. 593 of 2007 which was filed by the claimant for the purposes of enhancement of compensation amount. Patna High Court MJC No.6332 of 2013 (8) dt.07-02-2017 2/2 petition no plausible explanation has been given for non - compliance of peremptory order.

I do not find any ground to allow the petition. The restoration petition stands dismissed.
