====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for offences punishable under Sections 395 and 397 of the Indian Penal Code.

3. As per the prosecution case, on 29.12.2020, six unknown miscreants overtook a truck loaded with 500 bags of sugar and assaulted the driver (informant). Thereafter, they snatched the keys of the truck along with cash of Rs. 60,000/- from the informant and fled away with the alleged truck loaded with sugar.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner transpired during the course of investigation on the basis of the

Patna High Court CR. MISC. No.65971 of 2025(2) dt.05-12-2025 2/2 confessional statement of co-accused, Sanjeet Kumar. No incriminating article has been recovered from the possession of the petitioner and the petitioner has clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the general and omnibus allegations against the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let the above-named petitioner be enlarged on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Court of C.J.M., Motihari, East Champaran, in connection with Sugauli P.S. Case No. 662 of 2020, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
