1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Samastipur Muffasil P.S. Case No. 579/ 2019 dated 19.11.2019 registered for the offence(s) punishable under Section(s) 341, 342, 354B, 354A, 504 read with Section 34 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a neighbour of the informant and in between the parties, there was no good relation at the time of alleged occurrence, the allegation made in the FIR is totally false and as per FIR, the alleged occurrence took place on 09.11.2019 but the FIR, which is based on the

Patna High Court CR. MISC. No.72654 of 2023(2) dt.09-11-2023 2/2 written application, was filed on 19.11.2019 without giving any proper explanation regarding the said inordinate delay and the petitioner has fair and clean antecedent and there is no serious and specific allegation against him.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly taking into account the petitioner's fair and clean antecedent and inordinate delay in lodging the FIR by the informant, as stated above, this court is inclined to accept the anticipatory bail prayer of the petitioner. Accordingly, let the petitioner namedabove, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Samastipur Muffasil P.S. Case No. 579/ 2019 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
