The petitioners apprehend their arrest in connection with Gaya Muffasil P.S. Case No. 41 of 2019, registered under Section 366 (a) of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case merely because they are father and mother of Mohd. Aman. Further submission is that there is no specific allegation of kidnapping against the petitioners and there is love affairs between victim girl and Md. Aman. He further submits that the victim girl has filed a petition before the

Patna High Court CR. MISC. No.63064 of 2019(2) dt.18-10-2019 2/2 court below stating therein that she was not kidnapped by anyone and she has performed Nikah with Md. Aman and is residing with him as husband and wife as is evident from Annexure 2 and 2/A.

Having considered the above facts and circumstances of the case, let the above-named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Gaya Muffasil P.S. Case No. 41 of 2019 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
