====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-01-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 376, 511, 379, 34 of the Indian Penal Code.

3. As per the FIR, the petitioner is said to have tried to outrage the modesty of the informant.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has falsely been implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. All the allegations levelled against the petitioner is totally false and based on concocted facts. The real fact of the matter is

No.72147 of 2024(3) dt.10-01-2025 2/3 that prior to the alleged occurrence, the husband of the informant had borrowed money from friend of the petitioner, namely, Ajeet Kumar for running poultry farm and when the petitioner's friend demanded his money back, he was implicated in this case including the petitioner. It is further submitted that both the parties have compromised the matter and this statement is not denied by the learned counsel for the informant. Similarly situated co-accused has been enlarged on bail by this court vide order dated 05.10.2024 passed in Cr. Misc. No. 65128 of 2024. Learned counsel further submits that petitioner has four criminal antecedents as mentioned in para 3 of the bail application.

5. Learned APP for the State as well as learned counsel for the informant opposes the prayer for anticipatory bail.

6. Having regard to the facts and circumstances of the case, since similarly situated co-accused has been enlarged on bail, let the above named petitioner, be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Naubatpur P.S. Case No.17 of 2023, subject
