Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 379 of the Indian Penal Code.
The informant in his written complaint has alleged that on 19.09.2019 while he was returning after attending a marriage ceremony on his motorcycle three miscreants borne on motorcycle having Registration No.6777, overtook the motorcycle of petitioner and snatched away his bag containing video camera, still camera, mobile and purse containing document like driving license and identity card and thereafter all of three miscreants fled away on the motorcycle.
Patna High Court CR. MISC. No.61778 of 2019(4) dt.23-01-2020 2/3 F.I.R. is against the unknown, the looted article has been recovered from co-accused Vikas Kumar, who in his confessional statement has also disclosed the name of petitioner as one of his associate in said crime.
It has been submitted on behalf of the petitioner that he has been implicated in this case on the basis of confessional statement of said Vikas Kumar, and except said confession there is no other incriminating material against the petitioner. Neither looted article has been recovered from the possession of the petitioner nor he has been put on T.I.P. Petitioner was remanded in this case on 24.07.2019 from Hajipur Town P.S. Case No. 457 of 2019 except these two cases petitioner is not accused in any other case. Petitioner is in custody since 24.07.2019.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Hajipur Town P.S. Case No. 452 of 2019, subject to conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
