JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-10-2018 After some argument, the learned counsel for the petitioner seeks liberty to file an appeal under Section 32 of the Bihar Targeted Public Distribution System (Control) Order, 2016 against the order dated 29.12.2017 passed by the Sub-Divisional Officer, Aurangabad.

In view of the aforesaid, the present writ petition is disposed off with liberty to the petitioner to file an appeal within a period of four weeks from today and in case such an appeal is filed within a period of four weeks from today, the appellate authority shall examine the case of the petitioner on merits without being

It is needless to state that the appellate authority shall take into consideration the judgment of the Hon'ble Division Bench of this Court reported in 2012(3) PLJR 583 (Turant Lal Paswan vs. State of Bihar & ors.).
