2. The petitioner has preferred this application for grant of regular bail in connection with Raghopur P.S. Case No. 68 of 2024 dated 29.02.2024 registered for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, three unknown miscreants ridden on two motorcycles came from behind and stopped the informant and one of the miscreants tried to snatch the bag of the informant. In the meantime, one of them fired bullet on the informant which hit the thigh of the left leg of the informant and snatched the bag containing Rs. 2,00,000/- in
Patna High Court CR. MISC. No.70603 of 2024(2) dt.07-10-2024 2/3 cash, mobile phone, one tab, one micro ATM, finger scanner device, Adhar Card, key of motorcycle and bank passbook.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner was disclosed in the confessional statement of Sonelal Yadav. Nothing has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 04.06.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner. As per para-60 of the case diary, the petitioner has accepted his involvement in the instant case, out of Rs. 2,00,000/- cash allegedly looted from the informant, Rs. 4900/- and one country made pistol were recovered from the possession of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1,
Patna High Court CR. MISC. No.70603 of 2024(2) dt.07-10-2024 3/3 Birpur at Supaul in connection with Raghopur P.S. Case No. 68 of 2024, with the condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
