The petitioner is languishing in custody since 3.7.2019 in a case registered for the offence punishable under Section 392 of the I.P.C.
The prosecution case is that the informant's Forty Eight Thousand rupees were robbed by the motorcycle borne miscreants and the name of the petitioner sprang up during investigation when he was remanded from Mohania P.S. Case No. 198 of 2019. It is further alleged that the petitioner was also identified during Test Identification Parade. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and the petitioner's Test Identification Parade was conducted after he remained in
Patna High Court CR. MISC. No.62324 of 2019(2) dt.22-10-2019 2/2 custody for one month. It is further submitted that though the petitioner is accused in three other cases but he is on bail in one of those cases.
Learned APP submits that the petitioner has been identified during Test Identification Parade.
Considering the fact that the investigation has already been concluded and there is no recovery from the petitioner, coupled with the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 115 of 2019. (Dinesh Kumar Singh, J) anil/- U
