The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code. Later on, Section 412 of I.P.C. has been added.

The prosecution case, in short, is that unknown accused persons came to the house of the informant and on the point of revolver looted cash worth Rs.7 lakhs, jewellary and other articles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.06.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional

Patna High Court CR. MISC. No.61851 of 2019(2) dt.22-10-2019 2/2 statement of co-accused. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P. Other co-accused have been granted bail vide Annexure 2 series to the present application. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. case No.102 of 2019.
