JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 This is an application for grant of anticipatory bail in connection with Amas P. S. Case No. 215 of 2017, disclosing offences under Sections 323, 420, 468, 471, 504, 34 and 120B of the Indian Penal Code.

A complaint petition was lodged by the complainant, on the basis of which, F.I.R. has been lodged against the petitioner with an allegation that petitioner has sold 3.5 (three and half) decimals of land by registered sale deed to the complainant-informant, but later on, he came to know that Jamabandi of the petitioner was cancelled, as the land belongs to the State of Bihar.

Learned counsel for the petitioner drawing my attention towards the Annexure 3 and has stated that the Jamabandi of the land which has been sold to the complainantinformant has not been cancelled, which will appear from

Patna High Court CR. MISC. No.61927 of 2019(2) dt.27-09-2019 2/3 Annexure 3 and a false and concocted case has been registered against him. He is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner on the ground that petitioner is accused in several other cases. Further submission of learned counsel for the petitioner is that in those cases, in some of the cases compromise has been reached. Moreover,so far this case is concerned, this is a case purely in the nature of civil dispute. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J. Sherghati, in connection with Amas P. S. Case No. 215 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation.
