JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 The petitioner seeks regular bail in connection with Chhatapur P.S. Case No. 154 of 2019, registered for offences punishable under Section 376 of the Indian Penal Code and Section 4 and 6 of the POCSO Act.

Allegation against the petitioner is of committing rape upon the minor daughter of the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has been in judicial custody since 16.6.2019.

Learned counsel for the State opposed the prayer for bail on the ground that the girl in her statement under Section 164 Cr.P.C. has specifically named the petitioner as the person, who committed rape on her.
