====================================================== CORAM: HONOURABLE MR. JUSTICE A. ABHISHEK REDDY ORAL ORDER 07-01-2025 This matter is listed under the heading to be mentioned for modification of the order dated 26.11.2024.

2. This Court vide order dated 19.10.2023 had disposed of the CWJC filed by the petitioner seeking a direction to the District Magistrate to release the vehicle which was seized by the said authority. The court had directed the District Magistrate to pass necessary orders for release of the vehicle by imposing suitable conditions. Thereafter, the District Magistrate has passed the order dated 03.08.2024 whereby the petitioner was directed to furnish a bond to the value of Rs.18,00,000/-

Patna High Court CWJC No.15776 of 2024(3) dt.07-01-2025 2/3 (being the value of the seized vehicle). Aggrieved thereof the petitioner has filed the present CWJC. This Court vide order dated 26.11.2024 has disposed of the matter and inadvertently the earlier order passed by this Court in CWJC No. 12921 of 2023 dated 19.10.2023 was reiterated.

Learned counsel for the petitioner has stated that the petitioner is willing to offer security bonds of two trucks being Registration No. BR 10GC - 2932 and truck bearing Registration No. BR 10GC 2934, that the value of the two trucks is approximately Rs. 44,00,000/- and further the petitioner would not sell the above two trucks and prayed that a direction may be given to the District Magistrate concerned for releasing the seized vehicle bearing Registration No. BR 10GC 2931 by taking the surety bond for the above mentioned two vehicles.

4. Having regard to the above mentioned facts and circumstances, the order dated 26.11.2024 is recalled. The District Magistrate, Munger is directed to release the vehicle bearing Registration No. BR 10 GC - 2931 on the petitioner furnishing the surety bond for the two trucks bearing Registration Nos. BR 10 GC-2932 and BR 10 GC-2934. During the pendency of the criminal cases against the petitioner, he
