The petitioner is languishing in custody since 27.8.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that from the fodder house of Ramprit Das, 547.890 litres of country made liquor were recovered. The petitioner's name sprang up in the confessional statement of co-accused Santosh Yadav.
It is submitted by learned counsel for the petitioner that the alleged recovery has not been made from possession of the petitioner and similarly situated co-accused Santosh Yadav has been granted bail vide order dated 9.1.2019 passed in Cr. Misc. No. 80406 of 2018 and other co-accused Jairam Raut has bee granted bail vide order dated 17.8.2019 passed in Cr. Misc. No. 50218 of 2019 by Co-ordinate Benches of this Court. Learned APP submits that the name of the petitioner
Patna High Court CR. MISC. No.62524 of 2019(2) dt.23-10-2019 2/2 sprang up during investigation.
Considering the fact that the name of the petitioner sprang up in confession of co-accused, similarly situated coaccused have been granted bail and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge -II-cum-Special Judge, Excise Act, Madhubani in connection with Lakhnaur P.S.
