1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Krishnagarh Police Station Case No. 72 of 2025, dated 28.05.2025, disclosing offences punishable under Sections 126(2)/115(2)/352/351(2)/109/117(2)/3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, as per the First Information Report, is that due to land dispute between the informant party and the petitioner party, an alteration took place, in which co-accused Ram Babu Yadav caught hold the informant and the petitioner, along with co-accused Rakesh Yadav and Indal Yadav assaulted he informant by means of iron rod, lathi and danda, due to which the informant received

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to previous land enmity. He further submits that there is general and omnibus allegation of assault upon the petitioner and others and no specific role has been assigned to them. He next submits that there is case and counter case inasmuch as the wife of co-accused Ram Babu Yadav has lodged Krishnagarh Police Station Case No. 71 of 2025 on 28.05.2025, against the informant and others.

On the other hand, learned Additional Public Prosecutor vehemently opposes the prayer for anticipatory bail and submits that the informant has received multiple grievous injuries, one is on the right front parietal region of his head and rest two are fracture injuries of his left and right hand.

6. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that there is direct allegation of assault upon the petitioner, along with two other co-accused persons and the informant received multiple grievous injury on his body, I
