The petitioner is in custody since 19.01.2019 in connection with Khodawandpur P.S. Case No. 10/2019 registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 25(1-b),a,26,35 of the Arms Act. Learned counsel for the petitioner submits that the alleged recovery of motorcycle is of the brother of the coaccused Ankaj Kumar, namely, Pankaj Kumar, and the said motorcycle was not a stolen property. So far as recovery of arms is concerned, the petitioner submits that he has been in custody for almost nine months and prior to his arrest in connection with the present case, the petitioner had no criminal antecedent, but was subsequently remanded in two other cases which have been
