JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-09-2019 Grievance of the petitioner in the present writ application is non payment of honorarium for the period the petitioner has discharged the duty as Night Guard. Taking work and denying salary amounts to Beggari which is violation of Article 23 of the Constitution of India. Considering the scheme under section 70 of the Indian Contract Act as well as Article 23 of the Constitution, the respondents are hereby directed to make payment of honorarium for the period the petitioner has worked as Night Guard.
