Petitioner is in custody in connection with Deep Nagar P.S. Case No. 237 of 2019 for the offence under sections 30(A)©, 33, 36 and 38(B) of the Bihar Prohibition Excise Act, 2016.

Learned counsel for the petitioner would submit that in the instant case 40 liters of spirit was seized. He submits that spirit was seized from the joint family house and not from the exclusive possession of the petitioner.

Learned counsel for the petitioner submits that petitioner is in custody since 29.8.2019.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be

No.61490 of 2019(2) dt.30-09-2019 2/2 enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Nalanda at Bihar Sharif, in connection with Deep Nagar P.S. Case No. 237 of 2019, G.R. No. 4631 of 2019.
