JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 10-03-2015 The present contempt application is filed asserting the non-compliance of order dated 09.02.2010 passed in C.W.J.C. No. 3377 of 2002 whereunder the aforesaid writ application of the petitioners along with 29 others was disposed of with direction that the University to complete the process of appointment on vacant Class-III and IV posts in the College initiated by the issue of advertisement, as contained in Annexure-6, positively within four months. The cases of the petitioners shall also be considered, if they have applied in response to the advertisement, in accordance with law after giving them due relaxation of age.

Patna High Court MJC No.751 of 2013 dt.10-03-2015 2/2 Learned counsel appearing on behalf of petitioners submits that while the petitioners have applied for the Class IV posts but their cases have not been considered by the opposite parties. Learned counsel appearing on behalf of L.N. Mithila University, Darbhanga submits that the name of the petitioners have been recommended for appointment of Class-IV post but they did not appear before the selection committee for interview, so the appointment could not be made, on the other hand, many petitioners of writ application have been appointed, which would appear from the Annexure-4 to the contempt application. As such order under contempt has been complied.

In view of the above submission, since the order under contempt has been complied by opposite party, no action is required to be taken. Accordingly, this contempt application is disposed of with liberty to the petitioners to raise their grievance before the appropriate forum in accordance with law.
