In the light of the order dated 08.04.2015, a supplementary counter affidavit on behalf of the respondent nos.4 and 5 has been filed during the course of hearing of the case, which is taken on the record. In the aforesaid supplementary counter affidavit, it has been stated that, in the light of the office order dated 31.03.2015 (Annexure-R/1 to the counter affidavit filed on behalf of the respondent nos.4 and 5) passed by the Managing Director of the Bihar State Warehousing Corporation, the lawful dues of the petitioner have been calculated and it was found that an amount of Rs.2,18,472/- is payable to the petitioner. In view of the aforesaid averments, an A/C payee cheque
Patna High Court MJC No.455 of 2014 (3) dt.29-04-2015 no.031701 of State Bank of India dated 28.04.2015 in favour of the petitioner for a sum of Rs.2,18,472/- is being presented by learned counsel appearing on behalf of the respondent nos.4 and 5 before this Court and the same has been handed over to Mr.Madan Prasad Singh No.-2, learned counsel appearing on behalf of the petitioner, who undertakes to hand over the same to the petitioner himself.
In view of the payment of aforesaid dues to the petitioner through the aforesaid cheque dated 28.04.2015, this Court is satisfied that the order dated 11.02.2013 passed in CWJC No.4120 of 2005 has been fully complied with and no further action is required to be taken against the opposite parties. For the reasons recorded above, the present contempt petition stands finally disposed of.
