JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-08-2023 This application has been filed seeking modification of the order dated 28.10.2021 passed by this Court in Cr.Misc.No.19516 of 2021 whereby and whereunder this Court had while granting bail to the petitioner imposed a condition that in case it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of the bail bond of the petitioner. Learned counsel for the petitioner submits that after filing of the bail application, the petitioner had been remanded in another case which fact could not be brought to the notice of this Court at the time of hearing.

Having regard to the fact that this Court has already

Patna High Court CR. MISC. No.71184 of 2022(2) dt.16-08-2023 2/2 passed an order in Cr.Misc.No.19516 of 2021 based on the record of the said case and this Court is a Court of record under Article 215 of the Constitution of India, this Court finds no reason to modify its order on the basis of a different record which is now placed before this Court.

This modification application cannot be entertained, however, liberty is there to the petitioner to file a fresh bail application disclosing all the criminal antecedents. (Rajeev Ranjan Prasad, J) arvind/- U T
