JUSTICE ALOK KUMAR SINHA ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date : 16-09-2025 In the instant Writ petition, petitioner has prayed for the following relief(s):- "i. For issuance of a writ in the nature of Certiorari for quashing the recommendation/decision recorded in the Minutes of the Meeting of the Technical Committee held on 12.08.2025 in respect of E-Tender (NIT No. 02/2025-26 dated 23.06.2025), whereby the petitioner was disqualified on the alleged ground of non-fulfilment of Clause 17(4) due to non-

For issuance of a direction upon the Executive Officer, Respondent No. 3, to declare the petitioner as technically qualified in respect of the aforesaid NIT and consequently to open and consider the financial bid of the petitioner in accordance with law.
iii. For setting aside the financial bid table (Annexure-P/6).
iv. For restraining the respondents particularly Respondent No. 3 from cancelling the aforesaid E-Tender (NIT No. 02/2025-26 dated 23.06.2025) or publish any new or similar tender or re-tender.
v. For directing Respondent No. 3 to cancel the award of contract or the purchase order, if any;
vi. For directing the Respondent No. 3 not to proceed further or issue any order in the Tender E-Tender (NIT No. 02/2025-26 dated 23.06.2025) till the final disposal of this writ. vii. Award the cost of present writ petition to the Petitioner;
viii. Pass such other or further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case as well in the interest of justice."
2. Short question for consideration in the present lis is whether petitioner was required to file original affidavit in support of bid application or not? It is a disputed issue to the extent that petitioner submits that he had furnished original affidavit and it is disputed by the Respondents stating that

In order to overcome this type of issues, the employer who notify NIT is requested to prepare an index sheet for the purpose of bid application in order to highlight what are the documents attached with the bid application so that there cannot be any allegation relating to tampering of documents by either of the parties. This shall be taken note of by Maner Nagar Parishad.
3. Accordingly, the present Writ petition stands dismissed.
4. Copy of this order shall be made available to the Principal Secretary, R.C.D. for information.
