The petitioners seek pre-arrest bail in connection with Gopalpur P.S. Case No. 160 of 2019, registered under Section 302/34 of the Indian Penal Code.

The accusation is that in the morning of 12.06.2019 Ankit Kumar, nephew of the informant, Pramd Chandra Kumar, moved from house, but, he did not return till late night. On search, no trace was found, but, on next date at about 10.00 a.m, informant received information that the dead body of his nephew, Ankit Kumar, is lying behind the boundary wall of Style Bazar, then, he went there and saw the dead body. Informant raised suspicion about committing murder of his nephew by unknown accused.

Submission is that the petitioners are not named in the

Patna High Court CR. MISC. No.81271 of 2019(4) dt.17-06-2020 2/2 first information report. In course of investigation, one Sanny Kumar @ Sanki was apprehended by the police on suspicion and the police recorded the statement showing the names of petitioners having hand in murder of the deceased, except the confessional statement, as detailed in paragraph 40 of the case diary, nothing was collected against the petitioners. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Gopalpur P.S. Case No. 160 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Judge IX-cum-Additional Chief Judicial Magistrate, IX, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
