ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.08.2019 in connection with Sahajitpur P.S. Case No. 16 of 2019, registered for the offence under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the possession of the petitioner or from residential house of the petitioner rather recovered from the road side. It is further submitted that the alleged recoveries has been saddled on his shoulders. It is further submitted that apart from present case, only one other case instituted against the petitioner in which he has already
