1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Sarairanjan P.S. Case no.196 of 2023 registered under sections 379 and 461 of the Indian Penal Code.

3. As per the prosecution case, the informant states that on opening his mobile repairing shop in the morning it transpired that theft had taken place and various articles had been stolen.

4. Learned counsel for the petitioner submits that from the material on record including the order of the learned trial Court rejecting the application for bail of the petitioner, it would transpire that the F.I.R was registered against unknown. The petitioner was subsequently falsely implicated in the case in

Patna High Court CR. MISC. No.68782 of 2023(2) dt.01-11-2023 2/2 course of investigation on the alleged ground that one of the stolen mobile phone has been recovered from his possession. He is in custody since 28.7.2023 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR, the material that has transpired in course of investigation as is evident from the order of the learned trial Court rejecting the application for bail of the petitioner, his being in custody since 28.7.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sarairanjan P.S. Case no.196 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Samastipur.
