2. The petitioner seeks bail in connection with Laxmipur P.S. Case No. 231 of 2023 registered for the offence under Sections 30(a) Bihar Prohibition & Excise Act.

3. As per the prosecution case, approx 1987 liters of foreign liquor has been recovered from the vehicle in question.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.74032 of 2023(2) dt.29-11-2023 2/3 case. Petitioner is in custody since 23.05.2023. He further submits that petitioner is ready to donate Rs. 25,000/- (Rupees Twenty Five Thousand Only) in some charitable organization without accepting the allegation.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the period of custody and the aforesaid facts, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise 1st Jamui/concerned court below in connection with Laxmipur P.S. Case No. 231 of 2023 subject to condition that:- 7(I) The petitioner will mark his attendance at the Chandramandi, Jamui Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

7(ii) The petitioner shall deposit an amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) in Ramkrishna Mission Vidyapeeth, Deoghar and produce the
