1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Sursand P.S. Case no. 632 of 2022, registered under sections 420, 406 and 379 of the Indian Penal Code.
3. As per the prosecution case, the informant states that the petitioner was known to him from before. It is stated that the petitioner introduced him to Satyendra Kumar and Nagendra Kumar Sinha who took his truck on rent. Some rent for the said truck was deposited by the petitioner in his account, however, subsequently no rent was paid and on inquiry the petitioner disclosed that his truck had been stolen.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. From the
Patna High Court CR. MISC. No.71635 of 2023(2) dt.07-11-2023 2/2 contents of the FIR itself it would transpire that the petitioner is said to have introduced the other two persons to the informant and it was the other two persons namely Satyendra Kumar and Nagendra Kumar Sinha who had taken the truck of the informant on rent. The allegations are mainly of civil dispute for non-payment of rent and no offence is made out. The petitioner is in custody since 12.7.2023 and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations against the petitioner in the FIR, his being in custody since 12.7.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sursand P.S. Case no. 632 of 2022, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
