The writ application has been filed in representative capacity for restraining the respondent to act on the proposal for construction of MANREGA building in Gram Panchayat Raj Parto Karhari, Akbarpur in the District of Nawada. A counter affidavit is filed wherefrom it appears that the construction of the building is complete. The petitioner, in

Patna High Court CWJC No.25315 of 2013 (2) dt.20-07-2016 2/2 fact, now wants change in the name of the Gram Panchayat. Mr. Sinha informs the Court that a litigation in this regard is pending in this Court. Considering the fact that the construction of the building is complete and only the dispute pertains to the change in the name of the Gram Panchayat for which a litigation is pending, in my view, the writ petition has become infructuous. The dispute with regard to the change in the name of the Gram Panchayat shall be considered by the respondents after disposal of the pending litigation.

The writ application is disposed of.

Disposal of the case shall, however, not preclude the petitioner from ventilating his case before the appropriate authority in accordance with law.
