2. The petitioner in the present case is seeking prearrest bail in connection with Excise Case No. 916 of 2023 arising out of Excise P.S. Case No. 380 of 2023 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. He has got one criminal antecedent.
3. As per the prosecution story, the informant got secret information that this petitioner is selling illegal liquor in the rented house of one Anil Kushwaha. On such information, informant reached at the place of occurrence and upon search 14.500 litres illicit liquor was recovered from the room which was taken on rent by this petitioner.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68730 of 2023(2) dt.01-11-2023 2/2 petitioner is innocent and has falsely been implicated in this case. It is submitted that nothing has been recovered from the conscious possession of the petitioner.
5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner. It is submitted that there is a specific allegation against the petitioner that illicit liquor has been recovered from the room which he had taken on rent.
6. Having regard to the specific allegation that illicit liquor has been recovered from the room of the petitioner which he had taken on rent, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is thus refused.
7. This application stands dismissed.
