2. The petitioners have preferred this application for grant of regular bail in connection with Vaishali P.S. Case No. 471 of 2025 registered for the offences punishable under Sections 137(2), 96 and 3(5) of the BNS.
3. The allegation against the petitioners and other F.I.R. named accused is that they kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to village politics. All the manner and genesis of the
Patna High Court CR. MISC. No.68049 of 2025(2) dt.24-09-2025 2/3 alleged occurrence is totally wrong, false, fabricated and not maintainable in the eyes of law. As a matter of fact no such occurrence had taken place as alleged in the F.I.R. and entire story as set up by the informant is malicious, absurd and false. Learned counsel further submits that the informant is neighbour of the petitioners and merely on the ground of suspicion, present F.I.R. has been lodged against the petitioners and other coaccused who happens to be relatives of each other. It is also submitted that the petitioner no. 1 namely, Krishna Murari Kumar was not even present at the time of occurrence as he had boarded his train for Coimbatore (Tamil Nadu). Both the petitioners have no criminal antecedent and they are languishing in custody since 25.07.2025 without any fault.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

From perusal of impugned order, it appears that victim has stated in her statement recorded under Section 183 of BNSS that her father, mother and brother had scolded her with regard to her study, due to which she became upset and went to her sister namely Annu Kumari on her own and this fact has also been observed in the bail order of Asha Devi passed in Cr. Misc. No. 65874 of 2025 dated 17.09.2025.

Keeping in view the aforesaid facts and considering the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur, Vaishali in connection with Vaishali P.S. Case No. 471 of 2025 subject to the following conditions :- (i). Petitioners will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
