2. The present petition has been preferred for the following relief/s:

(i) for issuance of an appropriate writ/writs, order/orders, direction/directions to the respondents to declare the acquisition of land of the petitioners and others similarly situated persons under Land Acquisition Proceeding No. 2/6 of 1995-1996 lapsed as per provisions contained in Section 24 (2) of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 (For short the Act of 2013) as the possession has not been taken and to further restrained the respondents to take forceful possession over the lands in question against the provisions of law and for any other order/orders, direction/directions as your Lordships may deem fit and proper in the mentioned facts and circumstances of this case.

3. A counter affidavit has come on behalf of the

Patna High Court CWJC No.19756 of 2019(5) dt.13-01-2026 3/3 BIADA and learned counsel for the petitioners submit that in view of the statement made in paragraph-11 wherein the order of the Hon'ble Apex Court in the case of Indore Development Authority vs Manohar Lal & Ors. reported in (2020)8 SCC 129 wherein it has been observed that even though actual possession after the acquisition has not been taken over the by the authority, if the compensation has been paid, the proceeding of acquisition would not lapse under section 24(2) of the 2013 Act, he may be permitted to withdraw the petition.

4. Accordingly, the writ petition is disposed of as withdrawn.
