The petitioner is languishing in custody since 29.05.2019 in a case registered for the offence punishable under Section 392 of the IPC.

The prosecution case is that three unknown persons robbed the employee of the Petroleum dealership of the informant, leading to registration of FIR against three unknown persons. It is alleged that during investigation, name of the petitioner sprang up.

It is submitted by learned counsel for the petitioner that the petitioner was not named in the FIR. His name subsequently sprang up during investigation. It is further submitted that no recovery has been made from the conscious physical possession

Patna High Court CR. MISC. No.61953 of 2019(2) dt.27-11-2019 2/2 of the petitioner and the petitioner has not been put on T.I. Parade till date. Moreover, investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is made accused in two other cases, in which he is on bail.

Learned APP submits that the name of the petitioner sprang up during investigation.

Considering the fact that no recovery has been made from the conscious physical possession of the petitioner and the investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Begusarai in connection with Bhagwanpur P.S. Case No. 266 of 2018.
