2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 109, 126(2), 115(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3 . Prosecution case, in brief, is that co-accused Vishal Kumar and Vipin Kumar fired bullet upon the son of informant as a result of which he sustained gunshot injury. Petitioner is father of co-accused Vishal Kumar.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Specific accusation of firing is against co-accused Vishal Kumar and Vipin Kumar. There is no specific accusation of overt act against
Patna High Court CR. MISC. No.65920 of 2025(2) dt.22-09-2025 2/2 petitioner. Petitioner has been made accused in this case merely because he is father of co-accused Vishal Kumar. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Town Hajipur P. S. Case No. 271 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
