2. The petitioner is apprehending arrest in connection with Hulasganj P.S. Case No. 216 of 2025 instituted under Sections 70(i) of the Bhartiya Nayay Sanhita, 2023 lodged on 03.07.2025 by the informant, Kiran Kumari.

3. As per the prosecution story, the informant alleged that on 02.07.2023 when her younger sister had gone out to bring water after dinner, Ravi Kumar caught hold of her, dragged her towards the river and thereafter raped her. Later, he called this petitioner on phone who also raped her. Both the accused thereafter escaped from there. The victim returned home and narrated her ordeal which followed the FIR.

4. Learned counsel for the petitioner tried to submit that it was consented, learned APP opposes the prayer

Patna High Court CR. MISC. No.68396 of 2025(2) dt.13-10-2025 2/2 submitting that the girl cannot give consent to two different people.

5. There is force in the submission of the learned APP. The allegation of rape is/are against two persons, in that background, it would be appropriate that he seek bail.
