2. The petitioner has preferred this application for grant of regular bail in connection with Jamui P.S. Case No. 240 of 2024 dated 26.04.2024 registered for the offences punishable under Section 395 of the Indian Penal Code.

3. As per the prosecution case, eight unknown miscreants are alleged to have snatched motorcycle, mobile phone and Rs. 4,000/- from the informant and Kuso Singh, after assaulting them with lathi and danda.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The

Patna High Court CR. MISC. No.70297 of 2024(3) dt.18-10-2024 2/2 apprehended co-accused persons disclosed the name of the petitioner. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.05.2024. Similarly situated co-accused has already been granted regular bail by this court vide order dated 01.10.2024 passed in Cr. Misc No. 63405 of 2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jamui in connection with Jamui P.S. Case No. 240 of 2024.

7. The application stands allowed.
