JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-10-2019 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 01.08.2019 in a case registered for the offences punishable under Sections 302, 201 and 120B of the IPC.

It is alleged that on 28.07.2019, at 2 P.M., the informant along with her husband were working in the agricultural filed when his co-villager, Ravindra Yadav @ Master called her husband, when he left the agricultural filed, but he did not return. On the next day, the dead body of the husband of the informant was recovered from Dalan of one Yogi Yadav. Subsequently, co-accused Ranju Devi confessed that she along with other co-accused persons including the petitioner killed the husband of the informant.

It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.62575 of 2019(2) dt.25-10-2019 2/2 except the confession of co-accused, Ranju Devi, no direct evidence has been collected against the petitioner. The petitioner has been roped in the present case only on the basis of suspicion. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner is named in the FIR with specific accusation.

Considering the suspicious nature of accusation and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-V, Danapur, Patna in connection with Sigori P.S. Case No. 70 of 2019.
