====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-04-2025 Heard learned counsel for the petitioner and the State. Despite valid service of notice, nobody appears for opposite party no.2.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 323, 341, 379, 420, 307 498A, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, petitioner was married to opposite party no.2 in 2023 in a temple. Opposite party no.2 was running a Hotel for breakfast. One day, petitioner withdrew Rs.2 lacs from her account. After sometime, petitioner sold materials of the shop worth Rs. 5 lacs and when petitioner objected, petitioner tried to kill her by hurling hammer blow on her head.

Learned counsel appearing for the petitioner while denying the allegations, submits that petitioner is not wife of opposite party no.2 and the fact of his marriage with opposite party no.2 in the temple is false. Name of husband of opposite party no.2, as per Aadhar card, is Jamundev Mochi. Opposite

Patna High Court CR. MISC. No.75642 of 2024(4) dt.29-04-2025 2/2 party no.2 has also filed Complaint Case No. 1078/2023 in which she has written the name of her husband as Jamunder Mochi. A copy of complaint is annexed as annexure 2 to the bail petition. Learned counsel has further submitted that the petitioner is ready to settle the dispute with opposite party no.2.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let this petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 1, Patna City in Malslami Police Station Case No. 276 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
