2. The petitioner apprehends his arrest in connection with Excise P.S. Sadar, Siwan Case No. 439 of 2025 registered for the offences under Sections 30(a), 32(3) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution story, S.I. Amit Kumar received secret information on 30.06.2025 that Sanjeet Kumar had stored a large quantity of liquor at his shop in Shivdhari More, P.S. Bharharia. A police team conducted a raid at around 10:30 p.m., during which one person fled in the dark. In the presence of two witnesses, the shop (two rooms) was searched, and 502.560 liters of illegal liquor were recovered from the southern room. Witness Sunil Yadav identified the person who

4. Learned counsel for the petitioner submits that, according to the prosecution story, the alleged recovery of seized articles was made from a shop which is said to be belonging to the petitioner. However, the petitioner denies any connection with the said shop or ownership thereof, and asserts that he has been falsely implicated in the present case. It is submitted that the petitioner's main source of livelihood is farming, and for ulterior motives his name has been dragged into the matter. Learned counsel further submits that the petitioner has no criminal antecedent and without accepting the guilt, learned counsel for the petitioner proposes to deposit Rs.10,000/- in the welfare account of the Advocate Association of the Patna High Court.

5. Learned APP for the State opposes the prayer for anticipatory bail application.

Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the conscious possession and / or premises belonging to the petitioner and the petitioner having no criminal antecedent, accordingly, this Court is inclined to grant

7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Excise Court No.II, Siwan, in connection with Excise P.S. Sadar, Siwan Case No. 439 of 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023 and on production of the receipt showing deposit of Rs. 10,000/- as proposed on behalf of the petitioner.
