2. The petitioner apprehends his arrest in a case registered for the offence under Sections 399, 402 of the Indian Penal Code, Sections 21(b), 8, 20(b)(ii)A of the N.D.P.S. Act and Sections 25(1-B)a, 26, 27, 35 of the Arms Act.

3. It is submitted on behalf of petitioner that petitioner has been made accused in this case on the basis of confessional statement of co-accused, who was apprehended on spot. No arms or ammunition nor any narcotic substance has been recovered from the conscious possession of this petitioner.

4. However, learned A.P.P. for the State opposes the bail petition and submits that one country-made Katta has been recovered from the house of this petitioner and he has got four criminal antecedent.
