The grievance of the petitioner is that his raiyati land, appertaining to Khata Nos. 38 and 34, Plot Nos. 243 and 256 has been encroached upon by private Respondent No. 4. The issue involved in the present writ application relates to a dispute between the petitioner and Respondent No.4, with regard to a private land, which cannot be resolved through a writ proceeding as it requires leading of evidence, which can be resolved by a competent Civil Court.

Patna High Court CWJC No.1890 of 2018 dt.18-06-2018 2/2 Accordingly, the present writ application is disposed of with a liberty to the petitioner to approach appropriate forum for redressal of his grievance.
