The petitioner apprehends his arrest in connection with Special Case No. 347 of 2017, arising out of Vigilance P.S. Case No. 87 of 2017, registered under Sections 420, 467, 468, 471, 472, 477(A) and 120(B) of the Indian Penal Code and Section 13(2) read with Section 13(1) (d) of the prevention of Corruption Act.
The accusation is that in course of Vigilance inquiry, it was detected that District Programme Officer, Block Development Officer and Block Education Officer issued letter for appointment of 22 candidates for the post of Panchayat Teachers taking gratification and also ordered for their payment under conspiracy.
Learned counsel for the petitioner submits that, in
Patna High Court Cr.Misc. No.8776 of 2018(2) dt.17-02-2018 2/2 fact, the allegation against the petitioner is that in spite of sending the letter dated 184, dated 10.07.2015 by the Block Development Officer to the petitioner he was mum and not taken any action. Further submission is that, in fact, petitioner joined as District Programme Officer on October, 2015 after three months of the sending of the letter. Moreover, the appointments of 22 Panchayat Teachers have been declared valid by setting aside the termination order vide C.W.J.C. No. 11715 of 2017, 12725 of 2017, 11626 of 2017 and 11859 of 2017.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, VigilanceIst, Patna in connection with Special Case No. 347 of 2017 (Vigilance P.S.
