The petitioner apprehends his arrest in Sandesh P.S. Case No.178 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The informant alleged that he went to raid a place after having received secret information that somebody had kept liquor. The informant further alleged that some persons found fleeing away from that place and on search, 105 liters country made liquor was recovered.

The learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner surfaced in the case on the basis of the disclosure made by Choukidar that the petitioner was also found fleeing away from the place of occurrence.

Taking into consideration the facts aforesaid and the fact that nothing has been recovered from the conscious possession of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 4th, Bhojpur at Ara in connection with Sandesh P.S. Case No.178 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
