The petitioner has prayed for bail in a case registered for the offence punishable under sections 457, 380, 511 of the Indian Penal Code.
It is a case of attempt of theft by two accused persons including the petitioner who were caught on spot by the villagers and thereafter both the accused were handed over to the police party and from their possession two mobiles and two motorcycles were recovered.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner has been falsely implicated in this case. The alleged motorcycles were not recovered from the petitioner rather the same were standing in front of the house of
Patna High Court CR. MISC. No.70192 of 2023(2) dt.06-11-2023 2/2 Vikash Kumar. Petitioner has got no criminal antecedent and languishing in judicial custody since 22.7.2023. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Bidupur PS Case No. 419 of 2023.
