The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Section 366(A) of the Indian Penal Code.

Prosecution case relates to abduction of minor daughter of the informant by the petitioner and co-accused Lalit Kumar Mandal for marriage purpose.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Her statement was recorded u/s 164 Cr.P.S. in which she has made allegation of abduction against co-accused Lalit Kumar and not against he petitioner. She has not taken the name

Patna High Court CR. MISC. No.69683 of 2023(2) dt.06-11-2023 2/2 of the petitioner for any overt act. Petitioner has got no criminal antecedent and languishing in judicial custody since 14.3.2023. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM1st, Araria in connection with Baunsi P.S. Case No. 43 of 2023. (Sunil Kumar Panwar, J) sushma/- U
