JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 This is an application for grant of anticipatory bail in connection with Nauhatta P. S. Case No. 08 of 2018, disclosing offences under Sections 147, 148, 149, 341, 342, 323, 406, 467, 468, 120B of IPC.
As per complaint case, allegation against the petitioner that he got four sale deeds executed with respect to the land of the complainant in the name of his wife. Submission of the learned counsel for the petitioners is that in this case after investigation, final form has been submitted, but the cognizance has been taken. Moreover, the
Patna High Court CR. MISC. No.74260 of 2019(3) dt.09-12-2019 2/2 other accused persons have been granted privilege of anticipatory bail, vide order dated 22.08.2019 passed in Criminal Misc. No. 52428 of 2019. Further submission is that the dispute is in the civil nature. Petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, Saharsa, in connection with Nauhatta P. S. Case No. 08 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
