2. The petitioner has invoked the jurisdiction of this Court seeking a direction upon the respondents to ensure protection of his landed property duly mutated in favour of the petitioner, the particulars of which have been mentioned in Paragraph No. 1-(iii) of the petition.

3. Learned Advocate for the petitioner contended that the land, in question, was purchased by the petitioner and his brothers on 11.07.1978. Having purchased the land, the mutation was done and Jamabandi has been created in favour of the petitioner, despite the aforesaid fact, the private respondents making all kinds of nuisance. On being aggrieved by the illegal

Patna High Court CWJC No.14943 of 2024(2) dt.07-10-2024 2/2 action of the private respondent, the petitioner approached before all the concerned authorities including the Circle Officer for demarcation of the land, but the same has not been done till date.

4. Learned Advocate for the State countering the aforesaid submissions contended that the application filed on behalf of the petitioner does not speak for demarcation of the land, rather it appears to be boundary dispute.

5. Regard being had to the submissions made on behalf of the parties and considering the grievance of the petitioner, the present writ petition stands disposed of with a liberty to the petitioner to approach before the Circle Officer, Jiradei, Siwan for demarcation of the land, in question, on the basis of his registered sale deed, qua the revenue record.

6. If such an application is filed by the petitioner preferably within a period of four weeks from today, the Circle Officer, Jiradei, Siwan shall take appropriate action in the matter within a further period of three months from the date of receipt/production of a copy of this order.
