The petitioners are apprehending their arrest in connection with Rajgir PS Case No.265/19 registered for offences punishable under Sections 323, 324, 341, 379, 384/34 of the Indian Penal Code.
As per FIR, there is allegation against the petitioner of demand of Rs.20,000/- and further allegation is that on the next day, the petitioner and other accused persons came and there is allegation against the other accused persons of assault. So far these petitioners are concerned, there is allegation of snatching of Mangalsutra and ear-rings.
Submission of the learned counsel for the petitioners is
Patna High Court CR. MISC. No.61824 of 2019(3) dt.20-11-2019 2/2 that they are students and falsely been implicated in this case as they have also lodged a complaint case against the informant and others.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day..
With the aforesaid direction, this application is dismissed.
