JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-09-2018 The grievance of the petitioner is non-consideration of his case by the respondents for grant of promotion. Mr. Sunil Kumar Singh, learned counsel for the petitioner submits that during the pendency of the writ petition, the respondent Nos. 4 and 5 have retired and as such the petitioner has no grievance against them.

Referring to Annexure-A to the counter affidavit, counsel submits that vide letter of the Registrar dated 20th of May, 2017 the case of the petitioner is under consideration for grant of promotion and in that view of the matter, the writ petition may be disposed of with a direction to the University to

Patna High Court CWJC No.25503 of 2013(4) dt.26-09-2018 2/2 consider the claim of the petitioner for grant of promotion. In view of the letter dated 20th of May, 2017 of the Registrar, Annexure-A, the writ petition is disposed of with a direction to the University to take appropriate decision with regard to the claim of the petitioner for grant of promotion in accordance with law within a maximum period of four months from the date of receipt/production of a copy of this order.
